GENERAL TERMS OF USE
Welcome to the Autogrill Deutschland GmbH "Click & Good" application.
This platform is operated by Autogrill Italia S.p.A. with registered office in Novara, Via Greppi 2, and second registered office in Centro Direzionale Milanofiori, Strada 5 Palazzo Z, 20089 Rozzano (MI), fully incorporated. Share capital 68,688,000 euros, registered in the Novara Trade Register - tax number and VAT number 02538160033 - provided and managed as a one-person company under the direction and coordination of Autogrill S.p.A..
1. Purpose
The general terms and conditions set out below (hereinafter referred to as the "General Terms and Conditions") apply only to the Italian territory and to all orders placed by Users of the Platform.
The Platform allows the User to book and order a wide range of products (mainly food and beverages) in the authorised points of sale through an online booking service. Through this platform, Autogrill Italia sends the User's order to the point of sale, which then prepares the products selected by the User. Upon receipt of the confirmation that the order is available at the pick-up point, the user will pick up the product(s) at the aforementioned pick-up point.
2 General and scope of application
These General Terms and Conditions apply to all orders placed by users via this platform.
The General Terms and Conditions may be amended at any time. Amendments and/or new terms and conditions shall come into force upon their publication and shall not apply to orders already placed. Therefore, we encourage users to regularly review the platform and check the publication of the most recent General Terms and Conditions.
The General Terms and Conditions in force at the time the User sends the order shall apply.
In order to use the services offered via the platform, the user must be of legal age. Therefore, by accepting these General Terms and Conditions of Use, the User declares that he/she is of legal age.
Autogrill Italia declines any responsibility for damages caused by the inaccessibility of the service through the Platform or damages caused by viruses, corrupted files, errors, omissions, interruptions of the service, deletion of contents, problems related to the network, providers or telephone and/or telematic connections, unauthorised access, alteration of data, failure and/or malfunction of the User's electronic devices.
3. Orders
Once the User has accepted these General Terms of Use and the Privacy Notice, he/she may purchase one or more Products through this Platform by accessing the relevant section.
In the relevant section, the User may select the desired products and/or menus by clicking on them and following the instructions that appear during the purchase process before then making the payment.
The contract is concluded as soon as the payment has been made.
Once the order confirmation has been received by e-mail, the order cannot be changed.
Once the User has placed his/her order, Autogrill Italia will send the User, at the address provided by the User when placing the order, a confirmation email containing the following information: (i) details of the product(s) purchased, (ii) a detailed price, (iii) the point of sale chosen for collection, (iv) the order number to be presented at the point of collection, (v) the email address provided by the user.
Autogrill Italia cannot in any case be held responsible for failures and/or delays in the sending of emails due to force majeure or viruses,service interruptions, problems related to the network, providers or telephone and/or telematic connections, failures and/or malfunctions of the electronic equipment used by the User.
Autogrill will then send the user a new email to the address provided by the user, informing the user that the order placed is ready for collection at the point of sale.
If, after placing the order, you have not received any e-mails from Autogrill confirming the order and informing you of the availability of the product(s), please check that they have not been placed in your SPAM mailbox.
As the orders are food products and are perishable, the product must be collected within a period of 15 minutes after receipt of the second email sent by Autogrill to the User informing him/her that the order is ready for collection. After this period, the order will be cancelled and the price of the Product will not be refunded to the User. The customer is therefore advised to check the actual distance of the chosen pick-up location from his or her location at the time of payment in order to be able to meet the pick-up deadline indicated above.
4. Booking and purchase conditions
All products available on this platform are subject to actual availability at the point of sale.
All prices of the products listed are in euros (€). Prices are subject to change. The User will be charged the price for the Product listed at the time of the order sent by the User. In any case, the User can verify the total amount paid by consulting the order confirmation sent to him/her by e-mail.
The delivery times for the products/menus ordered at the point of sale vary depending on the product(s) selected.
Once the order has been sent, it cannot be changed.
In accordance with the provisions of Article 59, paragraph 1, letter d), [Italian] Consumer Code, the User cannot exercise the right of withdrawal for the products sold through this platform, as most of them are food products that can spoil or expire quickly.
5. collection of the products
The collection time at the point of sale for ordered products is 15 minutes from receipt of the email confirming the availability of the product(s) at the point of sale.
Autogrill Italia cannot in any case be held responsible for delays due to actions of third parties and/or force majeure.
The delivery of the product(s) shall be considered completed at the moment the product(s) mentioned in the order are made available to the user at the pick-up point.
The information on ingredients and allergens in the products may vary due to changes on the part of the manufacturers, which may temporarily lead to discrepancies between the information on the website and the information on the delivered products. We therefore ask you to check the information on the label or packaging (if provided) before consuming and/or using the product.
6. Price, payment and invoicing
This platform allows the User to pay for the products ordered using payment instruments belonging to the Nexi payment system, such as Google Pay, Apple Pay and/or credit cards, debit cards, prepaid cards with Visa or MasterCard logo.
Autogrill is authorised to change the aforementioned payment methods at any time.
Please note that Autogrill does not handle banking and/or financial transactions, nor does it offer banking, lending or money transfer services. Transactions made through the payment function of the Platform are exclusively subject to the general terms and conditions governing the individual Nexi payment systems and/or the terms and conditions of the issuer of the payment card.
As regards the processing of the personal data that the User must provide in order to use the various payment methods, the User must refer to the privacy policies, regulations and/or contractual terms and conditions provided by the service providers belonging to the Nexi payment system.
It should be noted that Autogrill does not process or store users' payment data (such as credit card data). According to these terms and conditions, these are processed by the payment service providers participating in the Nexi payment system.
In case of non-payment, Autogrill Italia will refuse the order in question.
The user will receive the tax receipt for their order directly at the point of sale when the product is issued. Please note that no invoice can be requested for this service.
7. Complaints
Any complaints regarding the service or the order can be reported via Autogrill's customer service by email to the following address [email protected] and/or by telephone on 800 069 069.
8 Applicable law and jurisdiction
The sales contract between the user and Autogrill Italia is concluded in Italy and is governed by Italian law. In the event that the User is a consumer within the meaning of the Consumer Code, the court of his domicile or address for service, if located on Italian territory, shall have exclusive jurisdiction to settle any dispute relating to the interpretation, execution or termination of these General Terms and Conditions or of the individual orders. In all other cases, local jurisdiction lies exclusively with the Court of Milan.
